[This is a complex will.] Introduction: Elizabeth Loving d. in 1808. In her will she left specific slaves to daughters Sally Loving and Peggy Loving and their respective female descendants. However, if Sally or Peggy died without female descendants, their share would go to daughters Mary Staples and Sukey Vaughan 50-50 each. Peggy Loving m. William Walker and had several children, so her slaves were not at issue. Mary Staples and Sukey Vaughan died, each with female descendants. Then Sally Loving died in 1837 with no living descendants.

This triggered the contingency whereby the descendants of Mary Staples and Sukey Vaughan retroactively inherited the slaves. The lawsuit was then triggered. Elizabeth Loving had daughters Nancy (m. John Hartgrove), Lucy (m. Charles Taliaferro) who are also mentioned in the will, but are not involved in the dispute over the slaves. Elizabeth Loving gave everything to her female descendants, so you will not find any mention of a son except for John, her executor.

Witnesses: William Loving, Joseph Loving. See Chancery Case 1840-009; and Inventory WB J.099. Note: A will contest broke out in about 1837 concerning to ownership of several slaves. This was triggered by the death of Sarah Loving, without descendants. Elizabeth Loving’s grandson George Vaughan reopened the estate to litigate the ownership of the slaves. The Chancery Case above explains everything. The Inventory above is a confusing mess.
