James Locke died in 1868 and Marion was named as admr. Jesse left a widow Mary and an infant son James. At age 21 the infant James would receive a moiety (1/2) of the estate; and the widow would have a moiety (1/2) of the estate for life; and upon her death or marriage her share would go to the infant son James. If James did not attain the age of 21, then the estate would be shared by the brothers and sisters of the testator. The son James Thomas Locke died and the widow Mary E Locke was living in the state of Tennessee. The brothers and sisters of the whole blood are represented by Thomas Locke and Nathaniel Locke of Georgia. [These siblings] are: Elizabeth Walker & her husband Thomas Walker; Mary A Walker & her husband Abner; Margaret W Howard & her husband P E A Howard; G Washington Locke; William Locke and your orator (James Locke). On 1 Dec 1862, his testator sold 100 acres known as Thackston Place (adj. Andrew Harbin and Pinckney Vaughan) to his brother in Law Thomas Walker for $700. The deed was in fee simple. Money damages were sought. Note: The petitioner won and the Thomas H Walker lost. |
