9 Aug 1808. Inventory of the estate of Stephen Herring and of Sarah Herring. Recorded Jan 1809.

7 Nov 1808. Division of slaves of Stephen Herring. Children?: Alexander, Sally Bennett (Granddau., dau. of Catherine Croom, then living in Georgia), Stephen B. Herring. (Slaves could choose who they lived with among the heirs of the estate. Recorded Jan 1809.

11 Feb 1809. Report of Committee to determine what part of the assets belong to the estate of Stephen Herring and what part belong to the estate of Sarah Herring. Alexander Herring was the admr. of Sarah Herring.

14 Apr 1810. Audited account of Sarah Herring. Allocated to Elisha Herring and the children of Alethea Harrell.

Note: a Fresh Look at Stephen Herring and His Wife Sarah. Stephen Herring made his will in Sep 1797 and it was probated starting the following month. In his will he left everything to his wife Sarah and a number of his children and grandchildren. The will is lengthy and very detailed. There is nothing to indicate that he left off any of his children that were living, or were deceased with living descendants. Notably, Elisha Herring was not mentioned in his will.


Fast forward to 1808. Sarah Herring died. She had no will. The court opened an intestate estate for her with Alexander Herring as her admr. Now here is where it gets interesting. The court appointed a committee to determine what part of her estate was part of her estate for life from the will of Stephen Herring (and hence still a part of his estate) and what part was hers in her own right. The only reason the court would do that is if Sarah’s children and Stephen’s children were NOT one and the same. The committee did its job and made its report finding she had £___ in her estate. Now, here is where it gets really interesting and very puzzling. Her estate was divided between Elisha Herring and the children of Alethea Harrell!. Please take a few minutes and let that sink in.


When read together, the only way this makes sense is as follows: Stephen Herring was married to one or more wives prior to Sarah and had several children. Sarah was married to another man also named Herring and had a son Elisha Herring. Then Stephen and Sarah were each widowed. They married and had a daughter Alethea Herring. Besides the obvious changes in the family tree, this would mean that Stephen Bright Herring is not Sarah’s son, hence her maiden name was not likely Bright.
